Might be a reference to Emiya being able to resist the shadow in HF because it doesn't work as well against distorted spirits.

That probably wouldn't matter much if it's just a case of being recorded. The Throne has copyied many monsters and Anti-heroes in itself despite them all being anti-humanity. To figure out truly tho. There may be a case if Naritia actually explores it. In SF there was this person who interacted and was enamored by DAs who should have been in the throne after death but wasn't. If that gets explored and we find out the guy was turned into a DA, died, and got in the throne or not, that would be the canon answer. But right now we don't know.

We don't know why pointed ears. Certainly not because of anything to so with elves. Whether elves exist or not I fate is something which was never confirmed.

She's not an elf, but elf ears seem to be a vague indicator for divinity in the Nasuverse (Semiramis also has them as a daughter of the Syrian fish goddess Derketo).

Personally I imagine elves would probably be a subtype of elemental spirit, seeing as they're generally considered "close to nature" in popular depictions.

Saber doesn't use Excalibur because of collateral. She was in a building, using her gigantic beam sword there would be unwise and could have had bad effects for Shirou and any civilians still there
