Considering people like Babbage and Phantom of the Opera are heroic spirits, what does it even take to become a heroic spirit in the nasuverse nowadays? A bit of fame and some achievments and you will forever be preserved as a hero of humanity? I feel like Grand Order has really cheapened what makes a heroic spirit.

Not exactly sure for Phantom but probably has do with A) central character in a world famous literary that's easily recognized by many people and B) if he's the same as in the book than he's a literal genius.

My main problem with Phantom was that he came after 1900, which it was stated no more heroic spirits came after then, other than through contracts like Emiya. It could maybe work if he is some kind of wraith rather than Heroic Spirit though.
While it's published in 1909, the book takes place in 1890 and (according to Wikipedia)

When the story takes place doesn't matter, as what matters is when people learned of him and elevated him to a heroic spirit. 1900 was stated as the cut-off for that being able to happen. For example, a character made in a book in 2017 shouldn't be able to be made into a heroic spirit even if he is based off a previously unfamous person from the 1600's. Since he did exist in the 19th century though, it might be possible in that universe he had some level of fame even before the Phantom of the Opera was written, but I don't think that was the intent since he even has Innocent Monster to match the book character.
Where exactly is this stated? I see this thrown around so much, and tried to look it up, but all I found is the mention in the VN where it says "the most recent [heroic spirit] is from 100 years ago", and nothing about there being a restriction. Is there any form of concrete source for this?

At any rate the year 1900 being a hard cutoff's never really been a thing, it's just that some point around 1900 is the cutoff. Maybe it's 1900. Maybe it's 1904 since SN takes place in 2004. Either way in this case since Phantom was around in the 1800s, even if there's historical distortion from a book published later, it's fine.

Speaking of modern weapons and guns, how do people feel about Billy the Kid being a heroic spirit? Billy definitely did become famous due to his gun, which is stated that you can't become a heroic spirit that way, but it was made a point that his gun itself isn't a noble phantasm and that he is supposed to be the symbol of the Wild West.
On another point, are there any heroic spirits that actually are agreed on to be against the canon and shouldn't be possible?

the way i see it, HS being accumulated legend means legens collected after a certain point of starting.
Phantom start line is 1890. The consequent legend and fame spreading is just an addition to that start line even if it happens later.
