The implication is that you can't summon servants because the "miracle that is the ritual of summoning a heroic spirit from the throne" wouldn't work. We can assume from what we know of the throne that HS exist all the same in tsuki worlds, most likely, we just can't access it (and although some fate works make it out to be plug-and-play to get your own servant, it's still supposed to be a miracle to make it happen). Ergo, no matter what they are, or who they are, they cannot be summoned (this is of course also ignoring the fact that a lot of those examples you mentioned would probably stem from some huge exception in whatever story they appear in, and not necessarily be from the throne in the first place).

Again, instead of Servant, I should instead just say "legendary oni, fairy, etc." that can be summoned as a Servant, if the Throne of Heroes can be readily accessed. If summoned in any other way, they obviously wouldn't be considered a Servant in the strictest sense.

It's not to do with what they are, it's to do with humanity's connection to... the greater humanity that is the Throne, I guess. Doesn't really matter the colour of the crayon you're trying to reach if it's on the thirtieth floor and you're a toddler.

But you could still find an oni or fairy to use as a familiar, they couldn't really be a legendary one since you would have to reach back in time to when they actually existed, right?

Or if you somehow find one that still exists in the present you then have to deal with the trouble of contracting an existence that's survived hundreds of years of Humanity wanting it dead/enslaved.

As for original Tsukihime,

Original Roa was mostly a cool guy but he barely showed up, only in dream scenes and right before death.

His current self was an unredeemable scumbag.

Haven't read remake but it seems there's more of Original Roa showing through.

How was Caligula involved in Grand ROMA's summoning, again? I read somewhere that Chaldea used his body to house Quirinus's spirit as a sort of Pseudo-Servant (since he's a god and all), but I may be heavily misremembering that part.

They made Aether as a summoning device to get a Grand, but even with that, they still needed a catalyst to get the specific Grand they wanted. Caligula was the catalyst and seemingly died in the process.
