And then the bit about Touko noting it's just like the first magic as opposed to the other ones and hinting that there could be potential trouble with the first.

That's the Rulers privilege yes, but how would that affect them not being summoned by the Einzberns? As a Ruler is summoned they would naturally be granted that privilege by the Grail, it what makes them Ruler. It doesn't matter if they were summoned by the Grail or not tho.
