Legally speaking they still didn't acknowledge the US As independent. Their defense would be it's no different from regular old conscription.

The REAL important thing to know about the war of 1812 is that by the time the actual fighting had started almost every demand the US had for the war had already been fulfilled, but news traveled so slowly that it wasn't known until too late, and funnily enough that same thing also caused the biggest battles of the war to be fought after the fucking thing was over.
