I feel as though you have a fundamental misunderstanding on what a Heroic Spirit and Noble Phantasms actually are.

A big deal was made about Semiramis having the Hanging Gardens despite specifically never having it in life, though. And that was heavily implied to be a rather unusual circumstance. Sort of implies there's at least some fact of the matter involved as to whether the Heroic Spirit actually owned the item in question (even if they can get it anyway due to popular opinion). Also the fact that some NPs work quite differently from how they were recorded in legend. Like Gae Bolg having a causality-reversal curse, for instance.

that's not called "fact" that's called "the Servant's legend" a legend is fundementally a tradition, a tradition is something humans pass on
