They definitely can make a design of the deities when they are not using any vessels, even if they don't make servants out of that. Nothing stop them from doing it whatsoever.

Not a god but Surtr did use Sigurd body for awhile. And Odin "technically" was using Cascu. And I think I prefer that over pseudo servants.
And even if we somehow got Shirou-Shiva, I can only imagine that a certain Hindu wouldn't take kindly to this.

a second joke for Shirou Shiva would be based on all the Hindu-Sakura`s getting hot and bothered at the sight of Muramasa/Archer and Shiva shows up swearing to prevent this NTR by wearing Shirou
No, but treating other peoples' religions with at least a little bit of respect, especially when we're talking about a living tradition with a billion+ adherents...should just be a bare minimum of a gesture of goodwill and thanks for letting you use their story..?
Like, I genuinely don't get the "freedom of creation" argument making it any less uncomfortably shitty to do?
Although I guess I'm a little closer to this than a lot of people since the person who taught me most of what I know about Hindu mythology is a practicing Hindu and all. It's a lot easier to say "freedom of expression" when you don't have a face to put to the people reacting to what you create.
I am honestly embarrassed that this is the case for us Muslims. I hope this type of behavior will decrease in the future, As it really doesn't benefit us in the long run since, well, new media interpretation is the way that people would remember our figures in history and culture.
Well that, and also, how are you supposed to implement a god that can, well, destroy the universe? Shiva's job is the destroyer after all.

I mean Kali is literally Right There and she's one half of that dance, so I really don't see that argument.
Arjuna's Noble Phantasm is supposed to nuke the universe if he uses it on the wrong target. The Brahmastra created the Great Indian Desert when Rama hit the wrong target.
Just scale it down, bro, it's easy.
Besides, Shiva only destroys when there is zero chance for salvation, and he is also a god of creation as well.
Even without Servant containers, just say that since we're now in the modern day human texture (well, not right now since the world is bleached but you know what I mean) and not in their old per-mythology texture, the world probably just prevents them from destroying shit anyway.
It's not really "when there's no chance of salvation," there's just a schedule for it. Eventually the world is going to run out of the power and virtue it needs to keep itself going and it's Shiva's job to tie it all up in a nice little bow so Brahma can make a new world. It's just the terminus of the process of entropy.
